Terms of Service

These terms govern your use of explorationmaps.com and the Exploration Maps application (the "Service"), operated by Exploration Maps ("we", "us"). By using the Service you agree to these terms. If you do not agree, do not use the Service.

1. The Service

Exploration Maps is a browser-based mapping tool for producing figures from mineral claim data, imported geospatial files, and your own annotations. You may use it without an account; creating an account additionally lets you save projects to the cloud, publish share links, and subscribe to a paid plan.

2. Your account

You are responsible for the accuracy of your account details, for keeping your credentials secure, and for all activity under your account. Tell us promptly at support@explorationmaps.com if you believe your account has been used without your authorisation. You must be able to form a binding contract in your jurisdiction to hold an account.

3. Your content

You keep all rights in the data, files, logos, and maps you bring to or create with the Service ("Your Content"). You grant us only the limited licence needed to operate the Service for you: to store, process, transmit, and display Your Content so we can render your maps, save your projects, generate exports, and serve any share links you choose to publish. We do not use Your Content to advertise or to train models, and we do not sell it.

You are responsible for having the rights to the data you upload, including any third-party or licensed datasets.

4. Share links

Publishing a share link creates a publicly readable copy of that map — including its geodata, titles, company and Qualified Person details, and any images you added. Share links are unlisted, not private: anyone with the URL can view them. Do not publish material you are not free to disclose. You can revoke a link at any time from your account, which deletes the shared copy. Links created without an account expire automatically after 30 days.

We may suspend or terminate accounts that breach this section. Where practical we will tell you why and give you an opportunity to respond.

6. Plans and billing

Free and paid plan entitlements are described on our pricing page. Payment, renewal, cancellation, and refund terms are set out in our Billing, Cancellation and Refund Policy, which forms part of these terms.

We may change plan pricing or the contents of a plan. For an existing paid subscription we will give at least 30 days' notice before a change takes effect at your next renewal, and you may cancel before then.

7. Claim data and professional responsibility

The Service queries public mineral claim registries and other public datasets. That information is provided by third parties, may be incomplete, out of date, or inaccurate, and we do not warrant it. Claim boundaries, ownership, and status shown in the Service are not a substitute for a title search, a legal survey, or official registry records.

The Service helps you prepare figures. It does not perform geological interpretation and cannot make any output compliant with NI 43-101, S-K 1300, JORC, or any other disclosure standard. A Qualified Person (or equivalent competent person) remains responsible for verifying, interpreting, and approving any technical content you publish, and for its regulatory compliance. You are solely responsible for what you disclose to investors or regulators.

8. Availability

We aim to keep the Service available and to protect your data, but we do not guarantee uninterrupted or error-free operation. We may change, suspend, or discontinue features. If we discontinue the Service materially, we will give reasonable notice and an opportunity to export your projects.

9. Disclaimers

To the fullest extent permitted by law, the Service is provided "as is" and "as available", without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, lost business, lost data, or reliance on registry information or map output. Our total aggregate liability arising out of or relating to the Service is limited to the greater of (a) the amounts you paid us in the twelve months before the event giving rise to the claim, or (b) CAD $100.

Nothing in these terms limits liability that cannot be limited by law, including for fraud or for death or personal injury caused by negligence.

11. Indemnity

You agree to indemnify us against third-party claims arising from Your Content, from your use of the Service in breach of these terms, or from your disclosure of material prepared using the Service.

12. Termination

You may stop using the Service and delete your account at any time. On deletion we remove or anonymise your data as described in the Privacy Policy. We may terminate or suspend access for material breach of these terms, for non-payment, or where required by law. Sections 3, 7, 9, 10, 11, and 13 survive termination.

13. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable there, without regard to conflict-of-laws rules. The courts of British Columbia have exclusive jurisdiction, except that either party may seek injunctive relief in any competent court. If you are a consumer, you keep the benefit of any mandatory protections of your place of residence.

14. Changes

We may update these terms. We will update the effective date above, and for material changes we will give notice in the application or by email before they take effect. Continuing to use the Service after a change takes effect means you accept the updated terms.
